COPYRIGHT POLICY

Tablecross, Inc. (“byFood”), located at WeWork Link Square Shinjuku 16F, 5-27-5 Sendagaya, Shibuya-ku, Tokyo, 151-0051, Japan, respects the intellectual property rights of others and expects its users to do the same.
Intellectual Property
The contents of the Services are protected by Japanese and international copyright and trademark laws and are owned by or licensed to byFood or its affiliates. Regarding User Materials (established in the following "User Materials" section) the contents are licensed to byFood by the user. The user may not reproduce, distribute, republish, upload, transmit, display, prepare derivative works of, publicly perform, sell, transfer, assign, license or use for commercial purposes any copyrighted material without byFood’s prior written consent. All rights not expressly granted in this copyright policy are reserved to byFood.
User Materials

You, the user, may post, upload, transmit and/or otherwise submit (hereafter "Submit") restaurant descriptions, reviews/comments, text, photos, images, and other content on the Site ("User Materials"). You agree to only post images that you personally own and that were not acquired through unlawful means or in breach of a third party’s copyright.

You acknowledge that User Materials may be routed through our servers, the servers of third parties on our behalf, and the Internet, and may be viewed by the byFood staff and by the general public on the Site.

ByFood retains the right to screen, refuse to post, remove, or revise User Materials at any time in its sole discretion without notice. If byFood elects to screen User Materials, there may be a delay in its publication as the review process takes place. If byFood has questions about your User Materials, byFood reserves the right, but not the duty, to contact you for additional information, including, for example, to verify that you have the rights to post the User Materials.

You retain the copyright and ownership rights to any User Materials that you submit to byFood. However, by submitting User Materials, you are agreeing that the information and images provided may be used by byFood and may be published on our website, social media, and/or in all other mediums. By submitting User Materials, you hereby grant byFood and its affiliate, a non-exclusive, irrevocable, perpetual, royalty-free, worldwide, transferable license to use, copy, sublicense, modify, transmit, publish, publicly perform, display, create derivative works of, host, index, cache, tag, encode, reproduce, edit, display, and/or adapt your User Materials in any and all media formats or channels, whether now known or hereafter devised, throughout the world and for any purpose including, but not limited to, byFood.com, its linked pages, applications and services, third party licensee websites, applications and services, over the air (on all forms of radio or television), byFood print publications, and other applications and services later devised, without compensation and without further consent or notice to you. You further grant byFood, byFood.com, and their licensees the right to contact you in connection with your User Materials and to use your member name, and other information that you have provided in connection with the User Materials as defined in our Privacy Policy.

In addition, you grant byFood’s third party websites and social media (such Instagram, Facebook, and partner API sites where byFood data is shared and/or promoted), applications and services, a non-exclusive, royalty-free, worldwide license to access your User Materials on or through the Services, third party websites, applications and services, and to use your User Materials pursuant to these Terms of Use and the terms of use of the third party websites, and as permitted by the functionality of the Services and third party web sites, applications, and services (such as through widgets, RSS feeds, and other methods similar or dissimilar, now known or later devised).

Entries that are published are selected entirely at byFood’s discretion. You acknowledge and agree that byFood shall have no obligation to post, display, or otherwise make publicly available any content, including photos and other information, submitted by you, and may, in its sole discretion, remove, edit, modify or delete any photo, information, or other content that you submit.

By submitting content, image(s), or information to byFood, you represent that the submitted content does not and shall not infringe on any copyright, any rights of privacy or publicity of any person, or any other right of any third party, and you have the right to grant any and all rights and licenses to byFood. You understand and intend that any photo, content, or information submitted by you to byFood may be available for viewing, rating, review and comment on by the public.

Intellectual Property Infringement

It is byFood’s policy, in appropriate circumstances and at its discretion, to disable and/or terminate the accounts of users who repeatedly infringe or are repeatedly charged with infringing the copyrights or other intellectual property rights of others.

In accordance with the Digital Millennium Copyright Act of 1998, byFood will respond expeditiously to claims of copyright infringement committed using the byFood website (the “Site”) that are reported to byFood’s Designated Copyright Agent, identified in the sample notice below.

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to byFood’s Designated Copyright Agent. Upon receipt of the Notice as described below, byFood will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Site.

DMCA Notice of Alleged Infringement (“Notice”)
  1. Identify the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by this Notice, you may provide a representative list of the copyrighted works that you claim have been infringed.
  2. Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or to which access is to be disabled, and information reasonably sufficient to permit us to locate the material, including at a minimum, if applicable, the URL of the link shown on the Site where such material may be found.
  3. Provide your mailing address, telephone number, and, if available, email address.
  4. Include both of the following statements in the body of the Notice:
    1. “I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use).”
    2. “I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed.”
  5. Provide your full legal name and your electronic or physical signature.
